Since, I went under binding and was set for design appointment I have since been told that the gray floors were not available and they didn't have a comparable option. The only option that they had to choose from was brown. They didn't even have an option to pay for gray floors.

Now my warranty is up and still no response from them.I just want this issue correct that was in the contract. One of the claims includes a leak that I have had from the upstairs master bathroom shower. I called multiple times and Stephen Elliott sent a plumber who just did a quick check and the drywall was repaired a couple of times because it leaked down into the living room. The tile company did come find the issue and repaired it. Now I'm having extreme difficulty getting Stephen Elliott to send someone to repair and paint the drywall. I have had the tile company reach out to them, I have reached out to the builder supervisor multiple times and I have even spoken to the owner's son multiple times and no one is responding.
We just moved into this newly built house in February and have had several issues already. The first guy he sent to fix the floors did absolutely nothing! The second guy cut out cut out pieces and tried to patch it with boards which left some small gaps in the floor boards and eventually did not resolve the squeaking. The 3rd set of guys that came in tried to fix the issue by putting nails along the edges of the floorboards. He siad he would having to get his boss involved at this point which I agreed to because no one wants to purchase a brand new home with squeaking floors. He was supposed to come by and look at the floors again, but he has not and I haven't heard from him since.
I didn't want gray and would not settle as had I known that before they would not have even been an option to purchase from in the beginning. Gray was non negotiable and a choice from the start. Since then I have terminated my contract and they will not return my 4k in earnest money stating that they had options. I am requesting my earnest money back in full as this was no fault of my own. Stephen Elliott has failed to complete the claims from my warranty from when I purchased the home.
